1. About this document
These terms are the contract between the operator identified above (we) and the company or authorised sole trader who creates an account in dunDesk (you, the customer). Creating an account means accepting them in full.
Two further documents apply alongside this one: the Privacy Policy, which explains what personal data we process about you, and the Data Processing Agreement, which governs our role as processor for your guests' data. The three are read together.
2. What dunDesk is
dunDesk is a web application for managing guesthouse bookings: your rooms, reservations, calendar, arrivals, housekeeping, prices and reports in one place. The service is delivered as software hosted by us and reached through a browser. We do not deliver the program as a file and you do not install it on your own equipment.
The service is meant for professional use by accommodation operators. It is not a consumer service.
3. The account
An account belongs to a single business. You declare the business details when registering; they appear on invoices and in documents generated from the application, and keeping them correct is your responsibility.
An account has one owner and may have further users (reception, housekeeping, administration), each with their own permissions. You are responsible for what the users you add do, and for keeping passwords safe. If you suspect that someone has reached the account without the right to, tell us immediately at the contact address.
A user can change their own password and close their own user account from the account page. Deleting the owner's account means closing the business in the application and is described in section 9.
4. The trial
Registration grants you a free trial of 6 months, with the full functionality of the granted plan. The trial requires no payment and never turns into a paid subscription by itself: when it ends, the account moves into the regime described in section 9.
5. Subscription and payment
After the trial, continued use of the application requires an active subscription. The available plans, their prices and what each includes are shown in the application, on the subscription page, and can be read at any time before choosing. Prices are stated in RON and, unless stated otherwise, exclude VAT.
Every plan carries a room limit. If you need more rooms than the plan allows, move to a higher plan; the application tells you when the limit is reached and never deletes anything you already have.
The mechanics of payment — whether the subscription is paid in advance for fixed periods or charged recurrently, which payment processor is used, how invoices are issued and on what terms — will be filled in here before payments open. Until then subscriptions are granted manually by us and the application carries no purchase button.
Invoices are issued to the business details declared in the account and made available to you in the application.
6. How you use the service
You undertake to use dunDesk only for your own accommodation business and within the law. In particular, you undertake:
- not to attempt to reach other customers' data and not to circumvent the application's security mechanisms;
- not to subject the application to automated loads beyond normal use that affect other customers;
- not to resell access to the application or make it available to another accommodation business;
- to enter only data you have the right to process, your guests' data in particular.
7. Your data
The data you enter stays yours. We do not sell it, do not use it for our own marketing and do not make it available to other customers. We process it solely to provide the service to you, under the Data Processing Agreement.
You can export your data from the application at any time while the account is active.
8. Availability and support
We make reasonable efforts to keep the application continuously available, but we do not guarantee uninterrupted availability. Planned maintenance is announced in advance in the application whenever it involves foreseeable downtime.
Support is requested from the application, in the support section. We answer during working hours, in the order tickets arrive and according to their severity.
9. Duration, suspension and termination
The contract is concluded for an indefinite period and lasts as long as you have an open account.
Expiry. When the trial or the subscription expires, the account is not deleted. Access narrows according to the policy shown in the application: you can still read and export your data, while new operations may be blocked. Renewing a subscription reopens full access.
Termination by you. You may leave at any time, from the application. Amounts paid in advance for the current period are not refunded, except where the law provides otherwise.
Termination by us. We may suspend or close an account for a serious breach of section 6, for non-payment after prior notice, or for use that endangers the security of other customers. Except in cases of immediate security risk, we tell you first and give you a reasonable period to put it right.
What happens to the data. After termination we keep your data for a reasonable period, stated in the Privacy Policy, so that you can export it, and then delete it. Documents the law requires us to keep — accounting records in particular — are kept for the period the law provides.
10. Liability
dunDesk is a record-keeping tool, not an adviser. Commercial decisions — prices, deliberately accepted overbooking, obligations towards guests — remain yours.
We are liable for direct, proven damage, up to the amounts you paid for the service in the 12 months before the event that caused it. We are not liable for lost profit, lost custom or indirect damage. No limitation in this document applies in case of intent or gross negligence, nor where the law forbids limiting liability.
11. Changes to these terms
We may change these terms. A change is announced by publishing a new version, and the application asks you to accept it at your next sign-in. The version date is printed at the top of this page, and each acceptance of yours is recorded. If you do not accept the new version, you may terminate the contract under section 9.
12. Governing law
The contract is governed by Romanian law. Disputes are settled amicably, and failing that by the competent courts at our registered office.
13. Language
This document is written in Romanian and translated into English. In case of any discrepancy between the versions, the Romanian version prevails.
